1. General

1.1 These terms and conditions (“Terms“) describe what applies when you use and/or make a purchase on apshaps.se (the “website”). Other terms and conditions apply if you make a purchase in our store or through any of our other channels, e.g. via email.

1.2 A.P. Shaps AB (company reg. no 559061-3427) (“A.P. Shaps“, “we” or “us“) provides e-commerce on the website. When you as a customer (“you“) place an order on the website, you enter into an agreement with A.P. Shaps which is governed by these Terms.

2. The Agreement and its Conclusion

2.1 These Terms describe what applies when you use and/or make a purchase on the website.

2.2 After you have placed the products you wish to purchase in your shopping basket, you will be able to view your basket and proceed with your order to the checkout. At the checkout, you can, among other things, choose the means of payment and view a summary of your order and the total amount to be paid. You will also be able to check and correct the information you have entered, such as the number of products and your chosen size. You can then confirm your order by clicking “Confirm Purchase”. Once you have clicked on “Confirm Purchase”, a binding order (offer) has been created, whereby you undertake to purchase the selected products.

2.3 Once A.P. Shaps has received your order, we will confirm receipt of your order by sending an order confirmation to the e-mail address you have provided. This does not mean that a binding contract has been concluded, but merely confirms that we have received your order. A binding contract is only concluded when your order leaves A.P. Shaps, or when your order is ready for pick up, and you receive a delivery confirmation which shall be deemed to constitute acceptance of your order. A.P. Shaps reserves the right to cancel parts or the entirety of your order before the delivery confirmation has been sent if one or more products in your order sell out before the order leaves A.P. Shaps. In such a case, we will inform you that we have removed the products from your order.

2.4 All contracts on the website are concluded in Swedish or English.

2.5 By placing an order on the website, you confirm that you are 18 years of age or older or have the authorisation of a legal guardian to shop on the website. In accordance with Swedish law, A.P. Shaps does not accept credit purchases from persons under the age of 18. A.P. Shaps reserves the right to refuse or modify your order in individual cases (for example, if you have provided incorrect personal data and/or have a payment default).

3. Product Information

3.1 For each product, there is a so-called product page with information such as the product’s characteristics and price. We reserve the right to correct any visual or typographical errors on the website. We reserve the right to correct any such errors at any time and to update or change the information on the website. If an incorrect price has been indicated for a product that you have ordered and we have not sent you a delivery confirmation in accordance with section 2.3, we will notify you and await your acceptance of the revised price before proceeding with your order. If you do not accept the revised price, the order will be cancelled. The amount paid will be refunded within a few days.

3.2 Images and videos on the website are for illustrative purposes only and we do not guarantee that they reflect the exact appearance of the products. Some colour differences may occur depending on resolution, photo quality and monitor. As our jewellery is uniquely handcrafted, weights and measurements stated on the website should also be interpreted as approximate and it is possible that your products may deviate from these to a minor extent.

3.3 The fact that a certain product is made available via the website at a certain time does not guarantee that the product will always be available. We therefore reserve the right to stop making a certain product or a certain size of a product available on the website at any time.

4. Certificate

A diamond certificate issued by the GIA (Gemological Institute of America) is included with all our diamonds of at least 0.30 carats. You will also receive a jewellery certificate issued by A.P. Shaps verifying that the jewellery was produced by A.P. Shaps. The jewellery certificate also states the name of the model, size, metal and any diamond information for the jewellery.

5. Prices and Fees

5.1 When you place an order on the website, the prices displayed on the website at the time of your order apply. All prices are in Swedish kronor (SEK) and include value added tax (VAT).

5.2 We always try to provide accurate information on our website, but sometimes mistakes happen. In cases where the price is obviously incorrect, and we have sent you a delivery confirmation under section 2.3, we reserve the right to cancel an order if you realised or should have realised that the price was too low. We will then contact you and notify you of the correct price and await your payment. We reserve the right to cancel the contract if you do not accept the corrected price, which means that you must return your order to us.

6. Payment Terms and Payment Methods

6.1 You can pay using the payment methods indicated on the website. We currently offer payment via Klarna.  

With Klarna, you can pay by card, bank transfer or through a bank account linked to your Klarna account. You can also pay by invoice or split your payment. For contact details and further information about Klarna and Klarna’s full terms and conditions, please click here

6.2 A.P. Shaps reserves the right to not always offer all payment methods and to change the payment method if the method you have chosen for any reason does not work at the time of your purchase or if you are not approved for the chosen payment method.

7. Delivery and Transportation

7.1 You can choose to pick up your products in store or have them shipped to you. We ship our jewellery insured worldwide with FedEx and their subcontractors. We bear the cost of delivery.

7.2 FedEx can normally deliver directly to your home, but in some cases, such as for smaller towns, your order will be delivered to a postal agent instead. You can track your delivery and get information on how it will be delivered using the tracking link we send you.

7.3 The delivery time for jewellery can vary depending on the complexity of the design of your jewellery and whether we have your jewellery in stock before ordering or if we need to create a new piece of jewellery. Estimated delivery time is displayed on each product’s product page. Thereafter, your order will be sent by post, whereby additional delivery time may vary depending on where the products are to be delivered.

7.4 Our ambition is to deliver all orders on time. Unfortunately, this is not always possible, and delays and deviations can sometimes occur. You will receive a delivery confirmation to your specified email address when your order leaves A.P. Shaps, or when your order is ready for pick up. The delivery confirmation will contain a tracking number that you can use to track your order. In case of any discrepancies regarding the delivery time, we will contact you by email or by text message.

7.5 If you do not receive your order within the stated delivery time, we will firstly undertake to fulfil the purchase within ten (10) days, calculated from the stated delivery date, by for example sending a new product (“replacement product”). If we cannot deliver exactly the same product as you ordered, e.g. the specific diamond you have chosen, the replacement product will be equivalent to your ordered product. Under certain conditions you may have the right to terminate the contract in the event of a delay in delivery, for example if we are unable to send you a replacement product or if the delay is of significant importance to you. If we have sent you a replacement product because of a delay or non-delivery, and you choose to collect the original product despite receiving the replacement product, we have the right to charge you for both products.

7.6 You will be notified when your parcel is delivered by FedEx. The notification can be sent by email or by SMS if you have provided your mobile phone number when ordering.

7.7 Parcels not collected within the time frame specified in the notification will be returned to A.P. Shaps. We reserve the right to charge shipping and insurance costs if the parcel is not collected. The cost amounts to SEK 1 000.

7.8 We ask you to inspect the products when you receive them and ask the carrier to document any damage to the parcel. You can make a complaint if your parcel is damaged when you receive it. You can read more about how to make a complaint under section 10.

8. Returns: Right of Withdrawal and our Return Policy

8.1 General Information on Returns

8.1.1 We know that it is not always easy to know if a piece of jewellery is right for you or the intended recipient. In addition to the statutory right of withdrawal of fourteen (14) days, we therefore offer returns for sixty (60) days from the day you received your products (the “return period“). You can read more about the right of withdrawal and our return policy below.

8.1.2 To exercise your right to return products, you need to inform us, preferably by email at info@apshaps.se, of your decision to exercise the right before the expiry of the return period by sending us an unequivocal message. Please include your name, address, e-mail address and order number in your message. You can find our other contact details at the bottom of these Terms. If you wish, you can use the model withdrawal form for exercising the right of withdrawal produced by the Swedish Consumer Agency (Sw. Konsumentverket). The form is available here.

8.1.3 Once you have sent your message in accordance with section 8.1.2 we will, for security reasons, book collection of the products via FedEx. Please note that the collection must be made from the same address to which the products were originally sent. You can also contact us at info@apshaps.se to book a visit to drop off your products directly at our store. You can find our address at the end of these Terms. Please bring the product that you wish to return and proof of purchase, such as your receipt.

8.1.4 We bear the costs for the return shipping when you exercise your right to return products, provided that you return the products to us in accordance with section 8.1.3. If you choose to return the products in any other way, you are responsible for the costs for return shipping. You must then ensure that the products are packaged and dispatched appropriately. Please note that you may be held liable for damage caused during transport if you have been negligent, for example by inadequate packaging or incorrect addressing.

8.2 Right of Withdrawal (days 1–14)

8.2.1 Almost all products purchased via the website are part of our standard range and can be returned. The exception is engraved products, which are not covered by the right of withdrawal because they are made according to your specifications or are in other ways clearly personalised. However, you can return engraved products within the framework of our return policy, please see section 8.3.3.

8.2.2 Once you have informed us that you wish to exercise your right of withdrawal in accordance with section 8.1.2. you must without undue delay and at the latest within fourteen (14) days send or return the products to our store in accordance with sections 8.1.3 and 8.1.4.

8.2.3 You are, of course, allowed to examine the products, but please handle them with care and only to the extent necessary to establish the nature. characteristics and functioning of the products. You must return the products complete, including all original parts and in its original box. We carefully examine all products, including diamonds, upon return to detect any use, replacement and possible damage. If you have handled the products to a greater extent than what is permitted or if any part is missing, damaged or altered, including if a stone has been replaced with a stone not from A.P. Shaps, an amount equal to the diminished value of the products may be deducted from the amount to be refunded in accordance with section 11.

8.3 Return Policy (Day 15–60 and from Day 1 for Products not Covered by the Right of Withdrawal)

8.3.1 To use our return policy, you must, within sixty (60) days of receiving the products, return the products via FedEx or to our store as set out in section 8.1.3.

8.3.2 The products must be returned in its original box, in its original condition, with its original materials and with all accessories. We carefully examine all products, including diamonds, upon return to detect any use, replacement and possible damage.

8.3.3 You can return engraved products within the framework of our return policy, provided that you return the engraved products within sixty (60) days from the day you received the products. We reserve the right to charge a fee of SEK 1 000 to remove the engraving after you return the products. We may deduct this amount from the amount to be refunded to you in accordance with section 11.

8.3.4 Remember to pack your products well and send them back to us in an appropriate way. You are responsible for the products on their way back to us, which means that you may have to pay for them if the products are damaged or lost.

8.3.5 A.P. Shaps has the right to refuse your return if the products are not returned in accordance with section 8.3.2. A.P. Shaps will in such a case send the products back to you.

9. Right of Exchange

To ensure clarity concerning what you paid for your products, which might be important if you need to show a receipt in connection with taking out insurance on your jewellery, we do not offer exchanges of products. If you wish to exchange your products, you are welcome to return the products in accordance with section 8 and to place a new order.

10. Right of Complaint

10.1 You can make a complaint to us if you consider your product to be faulty. A.P. Shaps is liable for defects for three (3) years from the delivery of the products. However, a prerequisite for you to make a complaint is that you notify A.P. Shaps of the defect within a reasonable time after you have discovered or should have discovered the defect by contacting A.P. Shaps customer service. Complaints made within two (2) months after you have discovered the defect are always considered to have been made within a reasonable time. However, please note that the longest time limit for making a complaint is three (3) years and two (2) months from the date you received the products.

10.2 Any errors and defects should always be reported to A.P. Shap’s customer service, preferably by e-mail to info@apshaps.se. You can find our contact details at the bottom of these Terms. When contacting us with a complaint, please provide your name, e-mail address, order number and a description of the defect.

10.3 A.P. Shaps is only liable for defects which existed when you received the products. A.P. Shaps is therefore not liable for e.g., wear and tear, damage caused by you or by others who have e.g. modified or worked on the products.

10.4 Once the products have been returned, and if the complaint has been accepted, A.P. Shaps will firstly repair the defect or provide new equivalent products (replacement). However, if repair or replacement is not possible or cannot occur within a reasonable period of time after the complaint and without significant inconvenience to you, you may be entitled to a reduction in price or to terminate the contract.

11. Reimbursement

11.1 Reimbursements are issued using the same payment method used for the purchase. In the event of a return (right of cancellation or a return within our return policy), reimbursement will be made without undue delay, but no later than fourteen (14) days after we have received your notice of withdrawal or exercise of our return policy. However, if we have not received your products within this period or if you have not otherwise supplied evidence of having sent back the products to us, we reserve the right to withhold the reimbursement until one of the aforementioned has taken place. In the event of a complaint, reimbursement will be made within the same time frame, provided that your complaint has been received in time and accepted by us.

11.2 Other methods may be used for the refund, provided that you expressly agree to such a change. This will not entail any additional costs for you.

12. After-sales Service

12.1 Jewellery and stones require meticulous care to maintain their condition and to avoid damage. We, therefore, offer free cleaning, polishing and claw checking of our jewellery (the “after-sales service“). You can use the after-sales service either by leaving your products at our store or by sending them to us via FedEx in accordance with section 8.1.3.

12.2 The after-sales service can be used once a year during the lifetime of the original buyer. If you have not used the after-sales service in one year, it is not possible to use it more than once a year in the following years. A.P. Shaps bears the cost of delivery when using the after-sales service.

12.3 In addition to the after-sales service, simple cleaning, such as through ultrasonic baths, can be done free of charge in our store an unlimited number of times. However, if you choose to not to leave your product in our store, you will be responsible for the delivery cost for sending the product back and forth to you.

12.4 The above services apply only to products purchased directly from A.P. Shaps. The services do not apply if someone other than A.P. Shaps has resized, adjusted, modified, or altered the jewellery, including if someone other than A.P. Shaps has changed a stone on the jewellery. You must provide a receipt to use the services. A.P. Shaps does not replace lost stones or stolen jewellery within the framework of the services.

12.5 You can also bring your jewellery to us, and we will repair it for a fee.

13. Resizing and Engraving

13.1 We offer one free ring resizing when you purchase a piece of jewellery directly from us. Please note that you must notify us of your wish to resize your ring within sixty (60) days from the date you received your products. Please contact us if you are unable to let us know whether your purchased ring needs to be resized within this time, and we will do our best to assist you.

13.2 You must return the products to us via FedEx or to our store in accordance with section 8.1.3 if you wish for us to resize your ring. We bear the cost of delivery for the first resizing. You are responsible for the cost of subsequent resizing and any associated delivery costs.

13.3 Please note that it is not possible to resize eternity rings as the band holding the diamonds are not suitable for this type of strain. If you want to resize an eternity ring which you bought from us, we can offer you an exchange for an equivalent ring in your preferred size.

13.4 We offer free engraving on engagement and wedding rings and on jewellery where engraving is possible.

14. Links to other Websites

A.P. Shaps may link from the website to other websites outside of A.P. Shaps’ control. The linked websites are not under the control of A.P. Shaps, and we are not responsible for the content or for the protection and privacy of any information or personal data you provide to other sites. You should exercise caution and read the privacy notice of the website in question.

15. Responsibility

A.P. Shap’s maximum liability to you for any loss or damage arising in connection with your order, placement of an order on the website or your purchase is limited to the extent permitted by law (for example, the Consumer Sales Act, Sw. Konsumentköplagen). Nothing in these Terms excludes or limits A.P. Shap’s liability where it would be unlawful to limit or exclude such liability.

16. Force Majeure

You are not entitled to compensation for any damage you suffer because A.P. Shaps is in delay or the products are defective if we show that the delay or defect is due to an obstacle beyond our control which we could not reasonably have been expected to have foreseen at the time of purchase and the consequences of which we could not reasonably have overcome, such as natural disaster, fire, war, or action by a public authority. This ground for exemption from liability for damages also applies if such an obstacle exists for another third party that we have engaged to fulfil the purchase in whole or in part. A.P. Shaps will inform you at the beginning and at the end of the relevant situation if any such obstacles should arise.

17. Processing of Personal Data and Cookies

18. Intellectual Property Rights

All intellectual property rights, such as trademarks and copyrights and the content and photographs on the website belong to A.P. Shaps or its licensors. Any use of the website and/or its content, including copying or storing such content, in whole or in part, other than for your own personal, non-commercial use, is prohibited without the written permission of the respective owner.

19. Amendments

19.1 A.P. Shaps may update these Terms from time to time. However, the version of these Terms in force when your order was placed will always apply to your and A.P. Shaps’ obligations in relation to the current order.

19.2 These Terms were updated on January 14 2025.

20. Invalidity

The invalidity or unenforceability of one or more provisions of these Terms by any court, authority or arbitral tribunal shall not affect the validity of the remaining Terms.

21. Alternative Dispute Resolution

21.1 We always strive to ensure customer satisfaction and will therefore, as a first step, work together with you to find a solution. If we are unable to resolve a dispute together, you can turn to an alternative dispute resolution entity (“ADR entity”). You can only use an ADR entity if you are an EU resident, and the other party is established in the EU.

21.2 You can either use the online complaint platform available on the European Commission’s website (link here), or contact the Swedish National Board for Consumer Complaints (“ARN“) directly via their website (link here). ARN is an accredited board for alternative dispute resolution under Directive 2013/11/EU on alternative dispute resolution for consumer disputes. If you submit a complaint via this platform, the complaint is automatically forwarded to the appropriate national competent ADR entity. The ADR entity then contacts A.P. Shaps and tries to resolve the dispute without involving the courts.

21.3 We undertake to follow decisions of ADR entities.

21.4 Disputes may also be heard by a Swedish general court.

22. Governing Law and Dispute

Swedish law shall govern the Terms and the agreement entered into on the website between you and A.P. Shaps.
