About A.P. Shaps Limited Company

1. General

A.P. Shaps Limited Company (559061-3427), hereafter referred to as “A.P. Shaps“, only enters into agreements with private individuals of legal age (minimum age 18 years). The consent of a guardian is required for people under 18 years of age.

The contract is concluded when A.P. Shaps has sent confirmation to the customer that the order has been received and is pending approval. When the customer has chosen to enter into an agreement with A.P. Shaps, A.P. Shaps has the right to store personal data to ensure a smooth and timely delivery of paid goods and use the data for marketing, communication and business development.

When purchasing the product from the A.P. Shaps’ website, the following information is required:

  1. First and last name
  2. Social security number
  3. Address
  4. Email
  5. Phone number

We reserve the right to store the above information in the form of a “customer profile” for future agreements between you as a buyer and A.P. Shaps. You can change your information at any time by emailing info@apshaps.se and using your electronic signature.

All personal data are protected from external access; that is, the customer must approve of this in writing. A.P. Shaps AB, Mailbox 699, 114 11 Stockholm is the data controller for personal data we register about you. We comply with PUL legislation, meaning that you as a customer, have the right, once per calendar year, to request any personal data we registered about you. If the personal data we have recorded about you is inaccurate, incomplete, or irrelevant, you have the right to request that we correct or delete such information. A request for the personal data we have registered about you or a request to update or delete the data must be sent to us by post and signed by you. 

As a customer, you can opt-out at any time and unsubscribe from further marketing communication.

All goods remain the property of A.P. Shaps until the goods are dispatched from A.P. Shaps and The Company receives full payment.

A.P. Shaps reserves the right to cancel purchases if fraud, other crime, personal bankruptcy, other insolvencies, or other similar acts are suspected.

A.P. Shaps reserves the right not to enter into a purchase agreement with the customer.

  1. Prices

All our prices are quoted in SEK and include VAT, which is currently 25%.

We reserve the right to adjust our prices with immediate effect and without prior notice. The current price of your purchase is the price stated on the website when the order was placed.

We reserve the right to make corrections in the event of errors, such as price or typographic errors. This policy also applies after purchase and/or payment has been completed. If this should happen, the customer will be notified immediately by email or telephone according to the customer’s information at the time of purchase. If the customer does not approve the correction, both the order and the purchase will be canceled, and the money will be refunded within a few days. No compensation or compensation of any kind, other than repayment of the payment, will be paid by A.P. Shaps.

  1. Payment

Payment will be made through Klarna, whereby Klarna’s terms and conditions apply between the customer and Klarna.

  1. Assortment

A.P. Shaps reserves the right to any errors that may appear on the website. We also reserve the right that an item may no longer be available or has been discontinued, or that the size of the product is no longer in stock or has been discontinued.

We reserve the right that pictures and films of stones and jewelry may deviate slightly from the real products.  All weights and measurements are estimates and may deviate slightly from the actual merchandise.

  1. Service rights

Jewelry and stones require extreme care to remain new and undamaged. Therefore, we offer free cleaning for diamond jewelry when the customer physically submits and picks up the product in our store. The cleaning service applies once a year for the lifespan of the original buyer. Such a service refers only to goods purchased directly from A.P. Shaps and on the presentation of a receipt. An item damaged by wear can be repaired at the cost of the customer. For a manufacturing defect, A.P. Shaps is responsible for the repair and all costs in accordance with  Swedish consumer laws.

Free cleaning does not apply if the ring has been resized, serviced, modified, or had any stone replaced by someone other than A.P. Shaps.

This cleaning service does not cover loss of the stone, or theft.

  1. Certificate

Certificates are included for all our diamonds 0. 30 ct. or larger.  Certificates are issued by GIA (Gemological Institute of America).

  1. Delivery

We always make every effort to ensure that you get your products on time. The standard delivery time for goods purchased directly on our website is 7-21 working days, depending on the complexity of the jewelry piece. Some goods require a longer delivery time of up to 28 days. Products in stock are usually sent on the same day or the next weekday after confirmation of payment. In case of a delay, you will be notified by email or phone according to the customer’s information at the time of the purchase. After a successful purchase, an order confirmation will be sent to the specified email address. Once the item has left our warehouse, you will receive an email with a tracking number to track the delivery progress of your package. All packages are sent by FedEx express and are insured by A.P. Shaps.

Suspicion of a lost package should be immediately notified to our customer service team at info@apshaps.se.

If the package is damaged in shipment, this should be immediately reported to the postal agent, and A.P. Shaps should be notified as soon as possible. You can email us at info@apshaps.se. If the package is damaged, the customer should not accept the package without appropriate documentation of damage. Thereafter, the customer should email info@apshaps.se within 24 hours to inform us of the situation.

  1. Means of delivery

A.P. Shaps offers free shipping within Sweden. We use FedEx Express for our domestic Express delivery. All our packages are shipped traceable and fully insured by A.P. Shaps.

A.P Shaps offers a free return, and if you wish to return the goods, this should be communicated to info@apshaps.se. A.P. Shaps will, in turn, prepare a return pick-up of the goods for you.

  1. Right of withdrawal

As the buyer, you have the right to rescind the order (return and exchange rights) within 60 days after product delivery. This policy pertains to all purchases made on the A.P. Shaps website. The right to withdraw from an ongoing purchase does not apply to self-designed jewelry. You must inform us via email if you change your mind. The message should be sent to info@apshaps.se. Your message should contain your name, address, email address, order number, and the items for which the return was requested.

A.P. Shaps is responsible for shipping costs when returning and changing goods. The return must be made with FedEx, and A.P. Shaps must book the pick-up of the item(s) to be collected from the same address to which the item(s) was sent.

In the event of a return or change of goods, the customer must notify  info@apshaps.se within 60 days from the time the item was collected. This notification process is necessary so that returns can be approved, money refunded or that the original item can be exchanged for a new one. If you wish to exercise your right to withdraw, there is a standard form for this procedure. The standard form is available on the Consumer Agency’s website (www.konsumentverket.se) but can also be sent to you by A.P. if you request it by email.

The return must be made in the same box in which the product was delivered in and in its original condition with all its accessories and sent with FedEx, traceable, and fully insured. The product should be unused. If the item has been modified, serviced, or had any stone replaced by a stone other than a stone from A.P. Shaps, the item will not be considered original and not accepted as a valid right of withdrawal.

The refund will be made within 14 working days of receiving the goods and A.P. Shaps has approved the return. Before the goods are returned or exchanged for other goods, they will be inspected for any damage, use, or impact. All diamonds will undergo a special thorough inspection in our laboratory to verify that the same diamonds have been returned and no damage has been done. If any of these circumstances occur, we will not accept the return and the money will not be refunded. A.P. Shaps will return the item to the customer.

Exchanging for another product or a product of a different size that is more expensive, any difference will be paid for by the customer.

You have the right to change the item once, which must take place within 30 days after delivery of the original item to the nearest postal agent. 

  1. Reclamation

If you have a complaint due to damage or incorrect production, A.P. Shaps requests that the product be returned for manual assessment. A.P. Shaps should be notified immediately if you believe the product has been damaged or faulted in some way and you would like to make a formal complaint. To make the complaint, email info@apshaps.se. The complaint must be made within a reasonable time from the discovery of the flaw. According to the Consumer Purchase Act, you always have the right to complain for a three-year period about any goods purchased from A.P. Shaps. Our right of complaint complies with the Consumer Law.

If the item has been modified, serviced, or had any stone replaced by someone other than A.P. Shaps, it is not considered original and will therefore not be accepted as a valid grievance. If the damage is deemed to have been caused by the customer, we reserve the right to deny compensation.

You must always notify A.P. Shaps at info@apshaps.se  or by phone, 08-410 095 02, as soon as you decide to make a complaint. If the complaint is approved, the customer will receive instructions on how to return the product. If approved, we will first try to fix the fault if possible. If we cannot repair the defect, the product will be replaced with a new one of the same quality, or the customer will be refunded if so desired.  The approved claims will be refunded within 14 working days of the date A.P. Shaps approved the complaint.

  1. Self-designed products

Self-designed goods include a CAD file and up to two changes. The company must receive full payment after the CAD file has been approved before production can begin.

When ordering a self-designed product with a diamond(s), we have the opportunity to offer a 360° film on selected diamonds. This does not apply to diamonds below 0.10 ct.

The right of withdrawal does not apply to goods that are self-designed in accordance with the customer’s wishes. If there is a complaint about a self-designed product, we will first try to fix the error. If the defect cannot be repaired, the product will be replaced with a new product, or the customer will be refunded if the customer wishes. However, the customer will not be refunded for the cad work performed. The price of the cad work will be specified in the invoice. 

A.P. Shaps reserves the right to decline a customer’s order for self-designed products. Such a right applies until the product is delivered to the customer. Any installment or payment will be refunded within 14 days after A.P. Shaps has notified the customer that the self-designed product will not be manufactured or delivered.  

  1. Engraved jewelry

Engraving is included free of charge for engagement and wedding rings.

Engraved jewelry can be returned or exchanged for a fee of 1000 SEK.

  1. Resizing

Resizing of our rings is included in the price on a one time per ring basis. Resizing must be notified within 30 days of the item’s day of delivery. After resizing, the ring is no longer considered original and the right to withdraw is no longer permissible.

Resizing the full eternity ring (infinity) is not possible because the shank holding the diamonds is not suitable for this type of stress. We offer to replace the ring with a similar one; however, we cannot guarantee that the exact same ring is in your size.

  1. Limitation of liability

We accept no liability for indirect damages that may arise as a result of production.

Events such as war, natural catastrophes, industrial actions in the labor market, government decisions, non-delivery from subcontractors, costly circumstances and equivalent events beyond our control, which could not be foreseen, shall be attributed to force majeure. This means that A.P. Shaps is released from its obligations to fulfill contracts entered into.

  1. Changes to the general terms and conditions

We retain the right to modify the terms and conditions at any time. Changes to the terms and conditions will be posted online on our website. The amended terms are considered accepted by the customer once the order has been processed or a visit has been made to the A.P. Shaps website.

  1. Choice of law and disputes

Swedish laws apply.

If a dispute cannot be resolved between our customer service and the customer, you can contact the General Complaints Board (see  arn.se). For EU residents other than Sweden, customers can contact the European Commission’s online dispute mediation platform (see  http://ec.europa.eu/consumers/odr).

If a dispute arises, we follow decisions from ARN or a relevant dispute resolution body.

In the event of a dispute not resolved through the dispute settlement body described above, a dispute can be resolved through court proceedings in Sweden. 

  1. Information about cookies

For privacy purposes, the Electronic Data Act provides that visitors to a website must be informed that cookies are used. The information in the cookies can be used to follow a user’s browsing activity. A cookie is a small text file that the website you visit requests to save on your computer to access various functions. You can set your browser to refuse cookies automatically. More information is available on the Swedish Post and Telecom Agency’s website.

  1. Personal data

By shopping at A.P. Shaps, you accept our data protection policy and our processing of your data. We protect your privacy and will never collect more data than is needed to process your order. We never sell or share your personal data with third parties without a legal basis.  

A.P. Shaps is responsible for processing the personal information that you as a customer have given us. We process your data to handle your order when you have requested newsletters or promotional offers. This is done to tailor marketing to your individual needs.

Below is a summary of how we store and process your data in accordance with the General Data Protection Regulation  (GDPR).

16.1 What is personal data?
Personal data refers to any information that can be directly or indirectly linked to a physical person.

16.2 What data do we store?
To handle your order and answer questions about your order (customer service), we store your first and last name, address, phone number, email address, IP address, and purchase history.

16.3 Legal grounds
In connection with a purchase, your data is processed to complete the agreement with you. Promotions and similar campaigns are made only after your consent.

16.4 What data is shared and for what purpose?
16.4.1 Payment provider

When a purchase is made, data is shared with our payment provider. Data stored includes the customer’s first and last name, address, email address, and phone number. If you choose to pay by invoice, the buyer’s social security number is also saved by the payment provider. The data is stored to complete the purchase and protect the parties from fraud. We use Klarna as the provider of our checkout (payment services).

16.4.2 Freight company
To deliver your order and complete our agreement, we must share some data with a shipping company to enable shipment of your order. The data shared with the shipping company includes the customer’s first and last name and address details for delivery. The buyer’s email address and/or mobile number may also be shared with the shipping company for notification.
The freight company we use is FedEx Express.

16.5 Right of access
You have the right to receive extracts of any data we have about on file. Extracts are sent electronically in a readable format.

16.6 Right to corrections 
You have the right to ask for updates of incorrect information or supplement insufficient information.

16.7 The right to remove all data
You can ask that your personal data be removed at any time. There are some exceptions to the right to delete your personal data. In some instances, it may be necessary to retain some data so that we can fulfil a legal obligation (for example, under the Accounting Act).

16.8 Responsible for data protection
A.P. Shaps has responsibility for storing and processing personal data for their online store and ensures that the rules/regulations related to data protection are followed.

16.9 How we protect your data
We use industry standards such as SSL/TLS and one-way hash algorithms to store, process, and communicate sensitive information such as personal data and passwords securely.
We use WooCommerce as our e-commerce platform, and Swedish servers operated by Oderland.se
